Waiting for an insurance payment can become stressful when you need transportation, medical care, or income you missed because of a crash. To understand the delay, first identify which part of the claim is still open.
A vehicle repair claim, a medical-benefits claim, and an injury settlement do not necessarily move on the same schedule. An estimate of how long one takes should not be treated as a deadline for all three.
Is the claim still being investigated?
The insurer may be reviewing coverage, responsibility, photographs, repair estimates, or medical information. Ask what remains outstanding and whether you need to provide anything.
Write down the claim number, the adjuster’s contact information, and the date of each request. If you sent documents already, keep confirmation of delivery and ask whether they were received.
Are your injuries still being evaluated?
An injury claim can require information about treatment and how the injuries may affect you going forward. Settling before those issues are understood can make it harder to account for future needs.
Ask your attorney how ongoing care affects the evaluation. An early payment offer should be considered together with the terms of any release you are asked to sign.
Has an agreement actually been reached?
Discussing an offer is different from completing a settlement. After an agreement, there may still be documents to finalize, funds to receive and clear, and medical obligations to address before the client’s portion is distributed.
Ask which step is pending. “We are waiting” is less helpful than knowing whether the issue is the release, the insurer’s payment, or the final accounting.
There is no single deadline for every accident claim
Florida’s Department of Financial Services explains that there is no statute setting one settlement timeframe for all automobile claims. Particular benefits, agreements, and circumstances can have their own requirements.
If the delay seems unreasonable, ask for a written explanation and discuss your available options. Keep the correspondence rather than relying only on phone conversations.
